The trial proceedings for this case, held on a Monday in the first week of July 2021, took place in Manacor, where the defendant rented a room. According to the prosecutor, the accused is said to have entered the minor’s bedroom and exposed her to sexual activities, creating a highly disturbing scenario for the child and impacting her sense of safety in her own home. The sequence of events allegedly continued with the individual positioning himself atop the girl, who resisted, and then being warned that if she spoke out, something worse might follow.
Later that same night, the defendant reportedly returned to the girl’s room. The prosecutor contends that the man pulled down his pants and underwear and engaged in masturbatory acts in front of the young girl. The child attempted to respond to the distress by fleeing the room and seeking help from her parents, an action that reflected her immediate resistance and need for protection.
At the outset of the proceedings, the defense moved to suspend the judgment by selecting a different legal representation. The defendant resigned from the court-appointed attorney and proposed a private attorney for the case. The request was denied, with the court determining that the timing of the motion did not permit the procedure, and recognizing that there were earlier opportunities that had not yet been pursued.
During his testimony, the accused denied the allegations of sexual abuse against the girl. He asserted that he had never entered the girl’s bedroom and sought to portray his relationship with the family as cordial, stating that they lived in a familiar environment and that the girl and he had formed a kind of familial bond similar to that of siblings. He claimed that they spent time together playing games, watching videos on platforms such as YouTube and TikTok, and maintaining a seemingly pleasant domestic routine. He described his own emotional state at the time as profoundly affected by a toxic romantic relationship, which he claimed had influenced his behavior and the dynamics in the household.
In further remarks about the minor’s behavior, the defendant suggested that the girl had acted in ways that did not align with her age. He claimed that the situation involved complexities and that he was not entirely responsible for how events had unfolded. According to the mother, the following day she contacted the household and told them that continuing in that living arrangement was untenable. She indicated that she believed the incident involved an invasion of privacy and a breach of trust within the family environment, and she disclosed that her daughter required psychological support to address the impact of the events. The mother described the emotional toll on the child and the family, noting that the daughter had to confront distress and fear as a result of what had occurred under the same roof.
