The court handed down thirteen years and six months in prison for continuing sexual abuse against one of the defendants’ daughters, a sentence later reduced by the amendment to the only yes is yes law. The reduction was appealed by the Elche Prosecutor’s Office. Judicial sources indicate that the detainee was acquitted of abusing another girl for lack of evidence in the same case, and faced trial in a separate matter for molesting a third girl who had been infected with a papillomavirus, although acquittal was issued on that charge.

Two sexual assault crimes

The second sentence was reduced at the request of the minister. The defense attorney, José Soler Martin, represents a 33-year-old man who was previously sentenced to a total of twenty years and six months in prison in 2019 for two counts of sexual assault and one injury. The seven-year term for aiding in the crime of sexual assault remains if the Elche Court finds the investigation inappropriate, while for the other charge the defendant received a sentence of thirteen years for sexual assault with penetration and for joint performance. The prison term was lowered from thirteen years to ten years and six months.

During the same proceedings, the prohibition on approaching and contacting the victim was reduced for this convict. The initial ban of thirty years has now been changed to fifteen years and six months. The rape took place during a birthday celebration in July 2006 at the La Pedrera reservoir in Bigastro. A minor was assaulted while restrained, and the offender sexually harassed the minor, benefiting from a reduction of nearly three years in the offender’s sentence, according to judicial records attributed to the case.
