Two Estepona municipal police officers were found to have sexually abused an 18 year old woman. The Malaga Provincial Court ruled on the case after the investigation known as Caso Abierto by Prensa Ibérica, sentencing the defendants to two years in prison. The two officers named Juan Carlos Galván and Vicente Peña, who went by the nicknames Ken and El Trilero, were dismissed from the force and ordered to complete a sexual education program. They were also required to pay the victim 80,000 euros in compensation.
The court also noted that the two ex officers would not serve more prison time immediately, as their sentences were suspended as part of a deal with the victim. The victim, then 18, experienced post traumatic stress and required ongoing pharmacological and psychotherapeutic treatment. She accepted the settlement to avoid reliving the traumatic night of June 9, 2018, as reported by sources in the case.
Night Out Details
The verdict describes the young woman traveling to the Costa del Sol with two friends to celebrate graduation and university entrance exams. The group drove from Madrid to Estepona, where the victim’s family keeps an apartment. They visited Mosaic nightclub, consuming a few drinks. As the night progressed, all partygoers were affected by alcohol, especially the victim, who was not a regular drinker and became visibly intoxicated, stumbling and having difficulty speaking clearly, according to the magistrates in the eighth chapter of the case.
An Early Stop and a Disturbing Turn
After a breathalyzer test, police officers arrived at the victim’s home. The trio left the nightclub around a quarter to six in the morning, with friend Luis driving and seeing an Estepona police car with flashing lights. He pulled over to avoid penalties for drinking. The two officers approached, exited the vehicle, asked about drugs, and detained the three teens.
The group then returned to the girl’s family apartment in a private, uniformed vehicle. Shortly after, the three friends were approached by the officers again. The victim wished to sleep, but a friend urged her to stay, saying the police were coming and that not complying would have consequences.
At the Apartment
The investigation reveals that one officer asked for the girl’s phone number and pressed for a connection with the officers. The other friend stayed nearby, hoping to keep the girl safe. The three teens spoke with the officers, and the victim expressed a desire to rest, while her companion urged her to comply with the police demands.
The Alleged Orgy Confrontation
During the encounter at the apartment, the officers manipulated the situation, suggesting sexual involvement with two cops as a way to secure compliance. The prosecution argued that the two city officials tried to coerce the victim into sexual acts, alleging a discussion about who would be involved and how the encounter would unfold. The victim refused to participate and was subjected to humiliation as she was stripped in the process.
Inside the residence, one officer allegedly used his status as a police officer to coerce the victim and even consumed cocaine while the other officer remained inside with her. The assault involved non consensual sexual contact, occurring without a condom and against the victim’s will. A nurse who attended nearby later notified national police about the incident.
One officer eventually left the apartment, but the remaining officer did not resist and continued the assault. The scenario ended without the victim consenting to the acts, and the case progressed toward a settlement that allowed the aggressors to avoid further trials. The former officers were banished from law enforcement and will not be able to work in policing again.
