Torbe case: settlement over recordings involving underage individuals in Spain and Romania

In headlines, Ignacio Allende Fernández, a Spanish adult film producer known as Torbe, agreed to serve a two-year prison term and pay €65,000 in restitution. A young woman who had been recorded and had videos circulated on social networks without consent was sentenced for involvement in the distribution of material featuring individuals under the age of consent.

Although the Provincial Prosecutor’s Office had requested seven years and seven months behind bars, the parties reached a settlement during a hearing at Madrid’s 27th Criminal Court. The agreement was finalized outside the framework of a prolonged trial, with terms accepted by both sides.

As part of the arrangement, Torbe will be barred from contacting the young woman for four years and from working with minors for six years. The resolution also anticipated the possibility of prosecution for a third person connected to the events.

I waited for the videos to be published

The prosecutor noted that Torbe claimed he did not know the young woman was under 18 when the recordings were made. He admitted that two scenes were filmed for payment but learned of the age issue afterward and chose to delay posting the material online.

The office stressed that distributing the video caused harm, including moderate to severe post-traumatic stress for the person involved. The symptoms included recurring memories, distressing dreams, irritability, and disruptions to social life and education. The statement highlighted the incident’s impact on personal and family life and noted that schooling had to be abandoned because of it.

Accordingly, the Public Ministry sought charges for distributing and possessing child pornography, as well as for disclosing private information. It was recalled that the producer had spent six months in temporary prison in 2016, but the prior disposition was canceled. Whether Torbe would face additional prison time remained unclear, according to statements from his defense team to the press.

At the outset of proceedings, prosecutors indicated they would seek a postponement if Torbe did not appear in person for testimony, and if the agreement collapsed, they could pursue an annulment. The judge approved telematic notification to speed up procedures.

Complaint in Romania

The prosecutor’s office indicated that Torbe contacted a Romanian woman who claimed legal age in December 2012 and agreed to record two explicit videos for compensation. A stage name, Jessica Ping or Jessica Sing, and a collaborator known as JMR C were involved in pursuing a fine instead of a six-month custodial sentence.

After recording the material, the woman provided her ID to verify age. Born in 1995, she proceeded with the interaction, and the producer continued after waiting for the participant to reach the age of consent, publishing the two videos on his website despite knowledge she was underage at the time of recording.

These events were reported by the Romanian victim, who later contacted authorities.

The case forms part of a broader set of proceedings. On October 21, 2015, another girl was contacted by email to record a scene, with assurances that she was of legal age during the process.

The young woman sent several nude photos to Torbe. After multiple meetings, it was agreed she would visit his home for an intimate scene, with the defendant’s identity not yet known. It was alleged that she faced coercion or intoxication aimed at blocking consent. The recording captured the events on a mobile device, described in one line as consensual.

A week later, another participant of legal age joined the session. After that shoot, Torbe allegedly asked the participant to wear a Bilbao football shirt, lift it to reveal her chest, and shout a rallying cry while filming continued. The phrase Aúpa Athletic appeared in the footage exchange. On the same day, the defendant allegedly sent the video to a contact list that included FJMN and several football players, prompting a request for a three-year prison sentence for possession of child pornography without fully confirming the subject’s age.

Three days later, the participant reported that the video circulated widely and that she had not yet reached 18. Torbe reportedly tried to remove the material via a site’s messaging system. In November 2015, the young woman, with her father’s support, filed a formal complaint with the Alcobendas National Police Station.
