The Balearic Court Cases Turn to Harassment Allegations Involving a Minor

The trial of a 36-year-old man is scheduled to begin this Tuesday at 10:00 a.m. before the Second Division of the Balearic Islands State Court. He faces charges of repeated sexual harassment involving the daughter of his partner in Marratxí, and prosecutors allege that he transmitted sexually transmitted diseases to several people. The public prosecutor is seeking a prison sentence of twelve years.

According to the prosecutor, the alleged incidents date back to late 2018 and extend into November 2019. The accuser claims that the accused took advantage of times when the mother was away from home to engage in sexual conduct with the child, raising serious concerns about the safety and well-being of the minor and triggering a broader review of the case by authorities.

Prosecutors argue that the defendant knowingly exposed others to sexually transmitted diseases, although there are no definitive records indicating that he exhibited symptoms during the time of the events. They contend that it cannot be proven that the man was aware of his condition or that he could transmit it, a factor that adds complexity to the legal proceedings and the assessment of responsibility.

The prosecution outlines the core facts that they consider to constitute an ongoing pattern of abuse. They assert that a child under the age of 16 experienced persistent sexual exploitation, which would justify a sentence of twelve years in prison. In addition to the custodial term, the request includes ten years of probation and a special disqualification from positions involving contact with minors for a period ranging from three to five years beyond the length of the sentence. The final determination rests with the court, which must weigh the evidence presented and apply the applicable legal standards to the case.

In support of their case, prosecutors also seek compensation for the harm suffered by the victim. They propose a payment of EUR 1,500 to address immediate damages and a further EUR 30,000 to cover more substantial injuries and lasting impact on the child and family as a result of the alleged actions.
