Retirees have reason for relief. An error by the Tax Agency led several pensioners to receive as much as 3,000 to 4,000 euros in compensation for a past misstep by the tax authorities. The money is being returned by the Tax Agency to those retirees who paid more tax than was due during a defined portion of their working lives. The decision is backed by a ruling from the Supreme Court, which confirms the right of these pensioners to recover and receive their funds. — Source: Supreme Court

It was a Supreme Court ruling that established these retirees should receive between 3,000 and 4,000 euros because of Hacienda’s error during the period from 1967 to 1978. In that era, workers in sectors such as metal manufacturing, construction, or commerce were taxed on 100% of their pension when, in reality, they should have been taxed only on 75%. — Source: Supreme Court

Following complaints from some of the affected workers, the Supreme Court issued a decision acknowledging that the state had overcharged these individuals and that the money must be refunded. — Source: Supreme Court

Although the beneficiaries will not recover every euro they paid, the ruling specifies that at least the amounts paid during the last three years of the period, from 1975 to 1978, can be reclaimed. — Source: Supreme Court

To receive the money, Hacienda requires the claimants to act actively by submitting a manual application before the deadline, so they do not lose the right to a refund. The process is to be carried out online through the Ministry of Finance’s electronic portal. — Source: Supreme Court

How to Check the Status of the Refund

After filing the claim with the Tax Agency, applicants should log into the Rent services and review the personal file through the Draft/Tax Return Processing option known as Renta WEB. — Source: Supreme Court

To access this platform, the user can identify themselves in three ways:

  • with a digital certificate or electronic DNI
  • with Cl@ve if registered in the system
  • with the reference number from the draft or tax return of the previous year, a six-character code

Hacienda allows a six-month window to complete the IRPF refund for mutual beneficiaries once the Renta campaign ends. — Source: Supreme Court
