In Madrid, the Supreme Court confirmed the conviction of a man sentenced to nine years for shooting another person during a dispute at a bar on Carpintería Street in the San Blas district. The ruling aligns with prior decisions by the investigating court and the Madrid High Court of Justice, which found him guilty of attempted murder and illegal possession of a weapon. The court also ordered the defendant to compensate the victim with 15,250 euros for injuries and 20,000 euros for related damages.
The incident occurred on July 5, 2021, when two men began arguing inside the bar on Carpintería Street around 8:00 p.m. After others separated the fighters, the defendant reportedly told the other person, with intimidation in mind: “I will shoot you twice.” He left the venue and returned about half an hour later, carrying what authorities described as a firearm capable of firing short, automatic, or semi-automatic rounds. The weapon was noted as a 7.65 caliber in the Supreme Court decision, and the man faced charges of intent to kill the other person.
Fight
The accused fired two rounds. One bullet hit the other man’s leg without breaking the skin, while the second shot led to a rapid struggle as the assailant pointed the gun at the victim’s left neck and upper chest area. The bullets traveled through soft tissue, leaving no exit wound in the described trajectory. During the confrontation, the defendant allegedly struck the victim with the firearm and then fled the scene amid blows to the head.
The victim later described the moment as life-threatening. He reported suffering a left hemopneumothorax, a tear in the lower lobe of the left lung, crushed lung tissue, and multiple rib fractures described as 3rd through 7th. A small left renal laceration and a bullet lodged near the left kidney were also documented in the medical findings.
Judicial records indicate the victim required initial medical care and subsequent hospitalization for five days, including two days in intensive care. Medical treatment involved drainage of the hemopneumothorax and suturing of the affected lung tissue.
The report notes that healing took about 150 days, with the victim experiencing ongoing left-sided pain and relying on a fentanyl patch to manage movement-related discomfort and anxiety.
bullet in the body
The bullet remained embedded in the fat near the left kidney and left a scar in the right anterior region from the shot. In the course of the legal process, it was established that the defendant did not possess a valid gun license. The defense argued that the presumption of innocence was violated and pressed that the evidence did not sufficiently prove involvement in the events. However, the appeal was rejected because multiple witnesses corroborated the sequence of events.
Additionally, the prosecution established the defendant’s intent to kill, a finding supported by jurisprudence that defines deliberate action as a situation where a person understands the risk their conduct creates and nevertheless proceeds with actions that could lead to fatal outcomes, recognizing the high likelihood of a deadly result.
