One night in July, the accused entered the room where the younger girl slept and began to caress her. The victim, alarmed and resisting, managed to pull down her underwear, but the attempt escalated into sexual intercourse. The court notes that the child was in shock yet succeeded in pushing the man out of the room.

Later that same night, the defendant returned to the girl’s room and, this time, removed his pants and began to masturbate while attempting to perform oral sex. Before leaving, he warned the girl that if she told anyone, the act would be repeated. The frightened child did not disclose what happened until she sought medical treatment a few days later, presenting severe itching in the genital area. Medical professionals confirmed that she had contracted gonorrhea, a sexually transmitted infection, and she disclosed the rape at that time. In addition to ten days of medical care, the victim required psychological treatment for post-traumatic stress disorder.

The defendant denied the assault at the trial, but in his statement he corroborated the charges. The court found the victim’s account to be entirely credible. The mother also testified that she surprised the man as he left the girl’s room on the night of the incidents.

The court of the second division of the County Court determined that the accused committed sexual assault, sentencing him to seven years in prison. It was noted that three-quarters of the sentence had been served or that the defendant was eligible for access to a third-degree crime. He is to be expelled from Spain for seven years. The judges emphasized the serious consequences of the rape for the girl and ordered compensation to her.

The events took place on the night of May 21, when the man and his ex-partner argued at his residence. During the confrontation, the defendant punched the woman multiple times and then hurled her from the window. The victim managed to grasp the railing, but the assailant dragged her hands away in an effort to cause her fall. After the fall from a height of roughly five meters, he returned home to collect his belongings.

The assailant beat her again and threw her from the balcony a second time. On that occasion, the woman managed to soften the impact by gripping onto some cables.
