A protected minor disclosed a rape case in Alicante in 2021, reportedly aged 14 at the time, with the hearing taking place this week. The young survivor alleges she was sexually assaulted by a 28-year-old man from Elda who is among the defendants facing charges. The accused denies the rape, admitting only a kiss, while the prosecutors and regional government press for a decade-long sentence. During the oral hearing, the minor described the sequence of events in detail and insisted that she told the accused to stop, but her pleas went unheeded. The survivor also spoke of recurring nightmares that she has continued to experience years after the assault.
The events are reported to have occurred from the evening of December 13, 2021, into the early hours of December 14, 2021, amid a night curfew in Alicante tied to COVID-19 restrictions. According to the testimony of the underage person under guardianship at the hearing, she left the facility where she resided on the day of the attack and met two girls on Postiguet Beach. Their interaction soon included the defendant and other young people, who allegedly asked for a photo together.
What followed allegedly involved all parties proceeding to a nearby area near a plaza and a tram stop. The minor testified that, according to her account, the group invited him closer to the city center. They reportedly agreed, but three of the youths moved away with the defendant to a different location, where the assault is claimed to have occurred.
The survivor stated that the two young women she had met on Postiguet were aware of her age, and they reportedly asked for her Instagram contact to arrange her safe exit from the area when leaving the center. It is alleged that the group moved toward a location where the assault allegedly took place.
According to the victim’s account, during questioning by the prosecution, the driver claimed responsibility for driving the group and described pushing away his friends so that he could be alone with the girl. She recalled that he allegedly kissed her and claimed that consent was given, but she asserted that she did not want any sexual contact once they were alone.

Afterward, the survivor left the area alone and a bystander reported seeing her distressed state near Portal de Elche. That person contacted police, who then provided care at the scene and transported her to medical treatment.
In contrast, the defendant testified that he did not know the minor’s age or that she had fled from a center. He claimed the desire to ride in a car with the group and asserted that he only kissed the girl, denying any rape.
Two friends who accompanied the accused testified that they went out for a smoke and did not observe anything unusual or hear the girl calling for help. Their testimony was later scrutinized during the trial.
As part of the defense’s request, two psychologists prepared a report on the accused, noting a low IQ and limited cognitive abilities. The trial is scheduled to resume on July 4.
