The events are said to have occurred on the night between Saturday and Sunday at the home of a Valencia player, in the Torre en Conill de Bétera housing estate.
In addition to images and audiovisual material, messages found on the device could serve as crucial corroboration alongside witness statements and the medical report. It is a standard principle that for a sexual assault testimony to carry weight against the presumption of innocence, corroborating peripheral elements are often considered, which is why the phone extraction is deemed significant. Two other requirements include the absence of false mobile evidence and persistence in the incriminating narrative.
The Statements Were Recorded
As reported in an exclusive by Levante-EMV, the first to testify yesterday before the judge were the two alleged victims. They spoke for about two hours, detailing the sequence of events from meeting the footballer at a Valencia nightclub, to getting into a taxi, where one of the two alleges a consensual sexual interaction, to the two alleged sexual assaults claiming to have occurred at the private residence. One involved a charged act by the footballer on a 21-year-old woman, initially at a pool, then in a bathroom, and a second alleged contact by a second detainee, a player from Alcantarilla, with a 25-year-old in the same pool area.
The women’s testimonies were recorded to preserve every detail of their statements for transcription later. Both victims were frank and consistent with their earlier statements to the Guardia Civil, acknowledging that a dispute arose because one of them believed the other tolerated continued contact with the footballer after she realized the second party’s alleged involvement. This recognition marked a key moment in their narrative.
Specifics of the 21-year-old’s account described two alleged sexual assaults with bodily contact that this publication does not reproduce out of respect for the victim. Both women agreed on circumstances surrounding the group’s exit from the villa, and the moment when the second detainee allegedly struck the 25-year-old, causing injuries to her lip.
Rafa Mir reportedly maintained to the judge that all sexual activity was consensual, including both encounters with the 25-year-old and the later approach to the 21-year-old friend. The second detainee, named Pablo Jara, likewise denied the accusations in full. A fifth person present at the scene has given testimony to the Guardia Civil; the defense plans to use this account to argue that no assault was observed. The individual is known to be a friend of the players, and observers note that much of what happens inside the bathroom remains known only to Rafa Mir and his alleged victim.
For now, as the investigation continues, both suspects remain free with charges and with the protective orders requested by the prosecution and the private complainants in place. Specifically, each defendant received a 500-meter anti-stalking radius for the two complainants and a formal record of attendance. Rafa Mir has been ordered to check in at the court weekly, while the other defendant must do so every two weeks. Additionally, the judge barred the footballer from leaving the country and revoked his passport.
