The 36-year-old suspect has been held in custody since the incident and faces charges related to sentence commutation, causing harm, coercion, and injuries with deformities. He allegedly inflicted minor injuries on his former partner and a neighbor, while a lesser count of harassment was dismissed.

Beyond the prison term, the court ordered two fines totaling 720 euros and compensation to the victim amounting to 46,545 euros for temporary injuries, long-term effects, and personal injury from surgical intervention. Additionally, the defendant is prohibited from contacting or approaching the victim for a period of sixteen years and six months.

The defense attorney, Pedro Diego Pérez, indicated plans to appeal the sentence, arguing that the court should have applied expressed consideration for the victim’s own acknowledgment of improved condition due to drug abstinence.

The court rejected the defense version that an accidental spill of oil explained the events. Instead, it credited the complainant’s account as clear, impartial, and independently corroborated.

Proven facts

The acts described in the sentence occurred on the morning of August 29 last year at a residence in Elche, where the ex-wife resided and where a precautionary detention or restraint had prevented any approach due to prior abuse complaints. The defendant reportedly returned home at eight in the morning, forced entry by breaking the door frame, and immediately searched inside, pushing belongings from the closet aside as the ex-partner attempted to keep him out.

Despite clear warnings from the victim, entry continued. The assailant aimed to gain entry and fled only after the victim threatened to call authorities if the door did not open. The decision notes that he managed to re-enter the home later that morning, leading to a heated confrontation. By around noon, the victim was in the kitchen preparing to fry potatoes when the defendant appeared, seized the frying pan, and threw hot oil onto the left side of the ex-wife with evident intent to seriously injure her.

He then exited the home and encountered a neighbor who had heard loud screams and came downstairs to intervene. The neighbor wrestled the attacker by the arms, during which the defendant bit the neighbor’s shoulder and pressed a finger near the neighbor’s eye in an attempt to escape. The arrest occurred in Elche on the same day, ending the pursuit.
