The Prosecutor of the Principality of Asturias seeks conviction for a fight that happened last January in the Emergency Department of the Asturias Central University Hospital. The prosecution asks for four years of prison for the crime of wounding with weapons or dangerous tools, with the aggravating factor of recidivism, and a separate fine for injury for the other defendant. The fast track hearing is scheduled for Friday, April 14, at 9:30 am in Criminal Court No. 2 in Oviedo.

The Public Prosecutor claims that around 14:00 on January 19, 2023, the two defendants went alone to the waiting area of the HUCA Emergency Department. They allegedly confronted each other about the status of a woman they both say they are dating, who had recently been involved in a car accident in Oviedo.
Upon entering, the two learned of the other person’s supposed relationship with the woman. One defendant punched the other, and the second defendant drew a knife and attacked the first in the abdomen with that weapon.
The first defendant sustained another injury, a small transverse cut about 2 to 3 millimeters long in the middle region of the eyelid, along with a bruise near the right brow. A second wound about 2 centimeters long appeared in the right ciliary area, requiring suturing away from the second finger on the right hand. It is not yet possible to determine if aesthetic sequelae will occur.
The second defendant, in turn, inflicted a one centimeter deep cut on the first defendant’s abdomen and wounded the right hand. He requested medical stitches for the injuries.
four years in prison
The Prosecutor’s Office contends that the first defendant is responsible for the crime of wounding, while the second defendant bears responsibility for wounding with a weapon or dangerous tool, aggravated by repetition.
Consequently, the prosecutor requests a prison sentence of four years for the second defendant and a one year term plus a fine for the first. Specifically, the first defendant would face twelve months of imprisonment and a daily fine of 15 euros with secondary liability for non-payment; the second defendant would receive four years in prison and a special disqualification from exercising the right to vote during the sentence.
The prosecution also seeks a protective measure lasting two years regarding both defendants, including prohibitions on communication and approaching each other within 300 meters, particularly away from their workplaces or any shared location. If violated, additional penalties would apply. Costs would be allocated as part of the judgment, with each side bearing a portion, and the court would account for medical expenses and related costs as needed.
Regarding civil liability, the Public Prosecutor requests the first defendant compensate the second defendant 400 euros, while the second defendant would remit 400 euros to the first. The amounts would be added to the penalties and any applicable legal interest. n
The parties would also be responsible for medical expenses recorded by Sespa as part of the total costs.
