Prosecution demands prison time and fines in nightclub incident involving a woman and a man in Barcelona
The public ministry is seeking two years in prison for a woman who broke a glass in the face of a man who allegedly inserted his hand under her skirt at a nightclub in October 2017. The same authorities are pursuing fifteen months of imprisonment for the man, who faces sexual harassment charges tied to the incident.
The fifth section of the Barcelona Court is scheduled to hear the case next Monday, bringing together the alleged sexual aggressor and the woman he approached. The prosecution is pushing for a harsher outcome, arguing that the incident involved injuries that justify time behind bars. The accusation notes that the injuries required medical treatment, which could influence the severity of the sanctioned penalties.
The court proceedings trace back to events at the Salamandra nightclub located in L’Hospitalet de Llobregat, near Barcelona, on 14 October 2017. It is alleged that the defendant, referred to as EG, placed his hand under the woman’s skirt, prompting her to push him away. The confrontation escalated, leading to a struggle during which the defendant allegedly restrained her by the neck. The provisional indictment describes that a glass cup was used during the confrontation, with the claimant reportedly striking him in the face with the cup.
The assault reportedly resulted in a concussion and injuries described as incisions and contusions that required stitches. The incident left what was described as a minor aesthetic deterioration, for which the defendant was seeking compensation. In the eyes of the prosecutors, the glass impact and the neck-grab form a sequence of actions that constituted bodily harm with consequences that extend beyond mere discomfort.
The Prosecutor’s Office views the act of injuring the woman during the neck hold and the subsequent clash as a minor offense under bodily injury laws, potentially punishable by a fine because the neck-related pain allegedly required only initial medical attention. The prosecution, however, argues for more serious consequences given the context and the alleged severity of the assault.
In this regard, the prosecution levels two charges against the alleged aggressor: sexual abuse and a related minor injury. To support these claims, it seeks a fine of 1,800 euros and compensation of 330 euros for the woman, in addition to a 15-month prison sentence. The narrative presented by the state contends that the combination of actions during the encounter constitutes a serious breach of personal safety and dignity and warrants significant penalties under the relevant statutes.
For his part, the man implicated in the case is facing a two-year prison term, with additional financial liability amounting to 1,400 euros to be paid for the injuries sustained by the other party. The court will consider all evidence, including testimonies and medical reports, to determine the appropriate outcome under the law and ensure that any ruling reflects the gravity of the alleged conduct while upholding due process for all involved.
