After acknowledging the facts and accepting the penalties requested by the public prosecutor, the magistrate issued an immediate sentence and imposed one year and three months of imprisonment, 57 days of community service, a prohibition on approaching and communicating with the complainant for one year, and a three-year ban on possession or bearing of weapons. The defendant, who initially faced sentences of three years in jail and has a prior conviction for a violation, knew he was prohibited from approaching his former partner within 200 meters and from contacting her by any means, due to a December 2022 court order granting her protection. Nevertheless, on the afternoon of November 23, 2023, he went to the victim’s home in the La Soledat district of Palma, entering the house using a set of keys he still held.
Inside the residence, the accused argued with his partner and struck her on the head with a decorative figure, intending to cause physical harm, according to prosecutors. The woman was injured but refused medical treatment and later chose not to press charges or pursue civil actions against him.
Returning to the residence a second time
Not satisfied, the defendant returned the following day, shortly after 9:30 a.m., to the same dwelling. On this occasion, he gained entry by breaking the door. The abuser hid inside the bed’s headboard, while the victim was away from home at that time. Local police located the man that same day and detained him. He has remained in custody since then.
