Woman Sentenced in Mallorca for Family Injury Linked to Homophobic Motive
A woman received a prison sentence on Monday for injuring her daughter after discovering the teenager had posted a rainbow flag on Instagram. The assault occurred at the family home in Ses Salines, Mallorca. The court found the act to be a family crime aggravated by homophobia, noting that the victim was targeted for her sexual orientation. The defendant admitted to beating the minor during the trial, insulted her, and spat at her in the moment of confrontation. The case will also be treated as a crime connected to family violence with a homophobic motive, according to the court’s assessment. The sentence includes a formal finding of guilt for injury and a report of the underlying circumstances.
The case was resolved through a criminal agreement reached in Palma between the defendant’s lawyer, the prosecutor, and the lawyer representing the Institut Mallorquí d’Afers Socials (IMAS), the agency protecting the victim from the moment the events occurred. A private prosecution was also part of the proceedings. The agreement provides compensation to the victim and sets conditions that influence the prison term. The compensation includes 1,000 euros for pecuniary damages and an additional 150 euros for non pecuniary damages and injuries. The court also ordered that the defendant refrain from approaching or communicating with her daughter for several years. The parties agreed to suspend the prison sentence on the condition that no further crimes are committed within three years and that damages are paid.
The events took place on November 1, 2020, in the family home. The 31-year-old defendant, originally from Morocco, was aware that her daughter was involved with another girl. That evening she observed a rainbow flag displayed on the daughter’s Instagram profile and reacted violently. The defendant entered the girl’s room, allegedly declaring that she would always be a target of insult and mischaracterization. She then grabbed the daughter by the hair, delivered multiple blows to the body, and reportedly threw a napkin ring toward her back while spitting. The confrontation left the teenager in need of medical attention and psychological care.
Following the incident, Social Services intervened and the Mallorcan Institute of Social Services assumed custody of the victim. Initial prosecution requested a prison term of three years for the defendant. Details of the case, including the agreement and the resulting sentence, emphasize the seriousness of family violence with a homophobic motivation and the legal consequences that follow such actions. The court’s decision reflects a commitment to protecting minors and addressing bias-based violence within the family context. [Citation: Palma court records, criminal proceedings summary]
