Malaga Case Update: Teenagers Released on Bail amid Investigation into Alleged Group Sexual Assault

The head of Malaga Instruction Court No. 5 is overseeing a case tied to allegations of a frustrated group rape against a woman at a public beach in Malaga. Two teenagers who had remained in custody since May 10 are now released on bail while the formal investigation continues. A lawyer for one of the defendants described the proceedings as having taken a decisive turn, noting that an appeal for reform had been filed after concerns about the process were raised.

According to sources from the Andalusian Superior Court of Justice, the release of the two men followed a prior request by the Prosecutor and a review of ongoing transactions. Although freed, they remain subjects of the investigation into sexual freedom offenses, including alleged sexual assault and an additional theft charge. Passport restrictions remain in place, and the men must appear at scheduled court dates and are prohibited from leaving the country. A third individual under investigation had already been provisionally freed after giving testimony to the security court.

Forensic sources cited by observers note that the release decision took into account audio material related to the alleged victims. They indicated that the recordings may reflect attempts to secure financial assistance or legal residency tied to the case. The story also appeared in regional outlets such as a local newspaper, which reported that a new report from law enforcement expanded the official file.

That additional document reportedly includes the testimony of a witness and friend of the complainant, who contacted local police to report messages and audio files suggesting the victim may have been unaware of the alleged sexual assault. The police response began in the early hours of a Sunday, following concerns raised about sexual assault, violence, intimidation, and theft involving three suspects aged 19, 30, and 31.

Initial police actions involved locating the victim’s belongings in the custody of one of the suspects. Investigators from the Provincial Citizens’ Security Brigade responded after receiving a call about a visibly intoxicated woman who appeared to be under sexual coercion. Officers located the trio near the victim, with one suspect reportedly in possession of the victim’s items at the time of arrest. Current inquiries indicate the woman had been socializing with friends before leaving a venue and being approached by one of the men as she prepared to return home.

According to the investigation, the encounter progressed with unsolicited advances. When the woman attempted to distance herself and decline advances, the other two suspects became involved, leading to concerns about coercive conduct and the safety of the complainant. The case continues as prosecutors and investigators work to establish the sequence of events and determine accountability for all involved parties.
