A Pension Fraud Case in Madrid County Court Unfolds
Madrid County Court is currently handling a case that involves a mother and her son accused of collecting 794.93 euros over more than two decades through a pension arranged for a relative who had passed away. The proceedings focus on whether those funds were improperly obtained after the relative’s death, and whether proper notifications to relevant authorities were made. The court will determine if any penalties or civil liabilities are warranted based on the information presented during the indictment.
The Madrid State Prosecutor is seeking a prison term of 18 months for the two defendants. In parallel, the defendants are pursuing civil compensation amounting to 37,250.72 euros, arguing that they reimbursed Social Security a total of 111,544 euros previously identified as overpayments. The outcome of these claims will hinge on the evidence regarding the management of the deceased relative’s pension and any corresponding access to related financial accounts.
As outlined in the indictment, the case centers on events following the death of the relative on November 18, 1995. The defendants are alleged not to have notified the National Institute of Social Security (INSS) or Banco de Santander about the asset that funded the pension paid to the deceased. Records indicate that, up until late November 2015, when INSS became aware of the facts, the pension funds were being deposited monthly into a Banco de Santander account jointly held by all three individuals involved in the case.
According to the charges, the trio allegedly used the account credentials to access the deceased woman’s debit card and to make purchases. They are also accused of withdrawing cash and using the funds to settle public debts attributed to MICM, the husband of one of the defendants, through embargo payments.
