A man living in Madrid has been sentenced by the Alicante Provincial Court to two years in prison after he contacted a 10 year old girl living in El Campello through the social network Instagram and persuaded her to send sexual content images.
When questioned at the start of the trial before a panel of the Third Section, the defendant accepted the facts after reaching a conformity agreement with the Public Prosecutor. The agreement included applying a mitigating factor for making reparations to the victim, following a deposit of 6,000 euros, and a second mitigating factor for delays in the proceedings due to the time elapsed since the events.
The events took place between January 26 and February 1, 2019. The court record states that the accused contacted the minor via the social network and sent an initial image of his private parts.
He then urged the girl to send him a photograph of herself. According to the court ruling, the defendant managed to convince the child to comply, and she sent him intimate photos and videos.
The defendant, for his part, encouraged her to send more images. Once again, the victim complied and sent new pictures.
The mother became aware
Eventually the mother of the minor learned about what had happened and filed a complaint in February 2019, which led to the investigation and the identification of the defendant.
Following the defendant’s admission of the facts at the start of the trial, the court found him to be the author of a crime of corrupting minors, in combination with a crime of sexual abuse of minors under 16 years of age via the internet, for which two years of liberty were imposed.
In addition to the initial sentence, the court imposed a restraint order prohibiting the defendant from coming within a minimum distance of 500 meters of the girl for six years and a further six years of supervised freedom.
The Alicante Provincial Court also found the defendant responsible for a second offense of exhibitionism, for which a fine of five months was imposed with a daily rate of six euros.
Nevertheless, the court suspended the prison sentence for three years on the condition that the defendant commit no further offenses.
