Madrid court considers trespass charges against six police officers

The Madrid Court of Magistrates, on an order issued in Madrid, authorized six National Police officers to be dispatched to a residence on Velázquez Street on March 22, 2021. The events followed closely after another incident in which six officers faced accusations of trespassing on Lagasca Street in the city center. In this sequence, three officers were involved in both operations, including the deputy inspector who oversaw the operation as a whole.

Subsequently, a court order accessed by Europa Press outlined plans to move these cases toward trial, potentially before a jury. The presiding judge indicated that the alleged facts could amount to trespass, and the six participating police officers would be named as defendants in the proceedings.

To advance the process, the judge summoned the defendants, the complainants, and other involved parties to appear at a hearing set for November 3. The purpose was to present charges, seek dismissal, or request further investigation.

On the day of the operation, after officers entered the apartment on Calle Velázquez in the Salamanca district, two teenagers filed a legal complaint against the police. The defense is led by attorney Juan Gonzalo Ospina, who also represents residents connected with the Lagasca Street case involving the related entry.

The complaint was directed to Order Court 26 in Madrid, where the president issued orders to proceed with the case. An appeal followed at the Madrid Provincial Court, which led to a decision that required magistrates to examine the police actions more thoroughly.

Judges reviewing the case noted that, at the time, the plaintiff did not have consent from the leaseholder named in the agreement for the specified address. The decision to enter the property had already been made, and while the officers’ instructions and repeated warnings were not heeded, the entrance was achieved using a sliding-entry technique without causing damage to the residence.
