Local Officer Faces Five-Month Sentence for Sexual Harassment in Asturias

The prosecution seeks a five month prison sentence for a local police officer from Cangas de Onís in Asturias, who faces a charge of sexual harassment against a female colleague. The oral hearing is scheduled to take place in the third chamber of the Provincial Court on Thursday, November 30.

The complainant had served as an assistant officer and later as a temporary officer within the same department. The defendant took advantage of the opportunities afforded by sharing shifts while on duty, engaging in intimate conduct that breached the woman’s boundaries. He performed acts of a sexual nature and repeatedly overstepped professional limits, including touching her thigh, stroking her, kissing her on the head, and sitting close in a manner that made her uncomfortable.

According to the prosecutor, on May 29, 2020, between 01:00 and 03:00, near the cemetery and the Cangas de Onís shooting range, while both were in a police patrol vehicle, the defendant touched her against her will. He lingered sexually while describing personal encounters with other women. At one point he moved his hands toward her groin area, and then drove the vehicle to the shooting range where they exited. As she leaned against him, he pressed himself closer, made continued remarks about his courtship experiences, and touched her again in a way that left her distressed.

Towards the end of October 2020, during a night shift at the Police Department, the defendant approached the complainant from behind while she worked at a computer and stated that she could be left to watch pornography in peace, and then kissed her on the head twice.

At approximately 01:30 on November 6, 2020, during a night shift, the defendant remarked about how he felt while looking at her eyebrows and grabbed her from behind, hugging her tightly and kissing her temple. He asked her to prepare a document, to which she agreed and attempted to stand up. He released her and placed another kiss on the same spot. Later, around 05:30 that morning, during the same shift, he asked the officer to sit in a dining hall chair facing him and queried whether she wished to socialize. He pressed further, asking about her age and encouraging her to reveal more, before telling her to go home for the night.

This conduct caused the complainant significant distress and anxiety, affecting her sleep. She sought help from the mental health unit and was diagnosed with an anxiety reaction. She received medical leave on November 23, 2020, with no specified return date. She subsequently informed the Local Police chief, who then reported the matter to the Civil Guard.

The prosecutor’s office maintains that these incidents constitute sexual harassment and requests a five month prison sentence for the defendant. It also seeks a restraining order preventing contact with the victim at her home, workplace, or any location she frequents, with a 200 meter prohibition and no direct or indirect communication for three years.

In terms of liability, the prosecutor’s office asks that the defendant pay 3,000 euros in moral damages to the victim, plus applicable legal interests.
