The case involved the misuse of an unconscious state caused by alcohol to commit sexual abuse against a 16-year-old girl. The individual, aged 20 at the time, admitted the facts presented by the prosecution, confirming that he took advantage of the victim’s unconscious condition resulting from excessive alcohol consumption. A hearing to establish the parties’ consent was held, with the defendant having previously confessed to the crime. The proceedings took place on a Tuesday before the Eighth Division of the Oviedo-based Provincial Court.
The convicted person’s account describes the circumstances around 2:00 a.m. on July 15, 2020. The defendant was with friends in a drinking area of Llanes when he approached a group of girls aged 16 and 17, including the victim. After a roughly one-hour conversation, the two moved a short distance away from the scene around 03:00. Despite being heavily intoxicated, the defendant allegedly engaged in sexual activity with the minor in La Calzada de Llanes, in the presence of other people. He states that the minor was unconscious at the time of the sexual act.
Following the incident, blood tests showed a blood alcohol content of 2.70 g/L in the young man. The Prosecutor’s Office emphasized that the actions occurred while alcohol impaired his intellectual and volitional faculties. Prior to the settlement decision, the defendant had already provided compensation of 20,000 euros to the victim.
Thus, considering the mitigating factor of intoxication and the compensation already paid, the acts were evaluated as constituting a crime of sexual abuse. In addition to the prison sentence, the offender was placed under a five-year supervised freedom measure, which requires participation in a program focused on sexual education. A ban on approaching the victim was imposed, along with a prohibition from visiting the victim’s home, workplace, or any location within 200 meters of her.
