Handover Dispute Highlights Child Safety Amid Family Proceedings

On an agreed handover planned for August 1, a mother refused to entrust her eleven-year-old daughter to the father. She stated plainly that protecting her child came first, overriding any formal agreement. The mother had asked a court in Ibiza to suspend visitations, citing a precautionary restraining order against the father. The petition asserted serious concerns about mistreatment and sexual abuse, a charge previously condemned in earlier proceedings.

The father argued that the court ignored the evidence he and his attorney had presented. Early on, when accusations of kidnapping emerged from the father, authorities treated the matter as a search and capture operation. The situation grew confusing for the child, who had warned that she would not be born while the disputes persisted and that both parents resided in her mother’s home. The allegations of sexual assault were filed within the same court handling visit suspensions and ongoing investigations. A key point in the petition stated that police advised the mother not to hand over the minor to her father, and that there was evidence suggesting the acts could constitute a crime against the child.

The mother and her attorney sought a halt to contact with the father after troubling videos surfaced on the preteen’s phone. The concern deepened as the girl returned from visits describing bruises or a sexualized dynamic with her father. More than a year and a half earlier, she had already sought protection with corroborating psychological reports, though she felt insufficient measures had been taken to shield her.

In November 2021, a police investigation began, including injuries observed at a hospital. The minor was asked to testify, a scenario the mother found deeply distressing. In January 2022, a separate report of injuries was added to the case, detailing claims about the father’s communication with the child and providing background from the attorney handling the matter.

When the mother viewed the videos, she said she was in shock for two days. She subsequently sought a restraining order with help from a National Police guardian. The material was presented to the authorities, and five officers reviewed it. The officers later filed the formal complaint themselves, without her drafting it. The July 21 report described the scene and the statements captured in the videos. The minor appeared to be in a compromised position, and the testimony suggested that the father had not respected the child’s boundaries. The documents noted that the child had asked the father repeatedly to stop touching her.

The mother contends that authorities were aided by other records, including reports from the Unified Registry of Child Abuse and a related procedure from the Child and Youth Mental Health Unit in Ibiza and Formentera Health Zone. The lawyer submitted a protection request that referenced these documents, including medical notes from a visit on July 27, 2023, and a psychologist’s report connected to the child during that period.

A Fresh Start, but Not Without Obstacles

Despite mounting evidence, the court process faced delays. The judge was on vacation, and the prosecutor’s office representative reviewing the file found no clear sign of crime in the stamping of the materials and did not support the injunction. The mother expressed her frustration plainly. She stated she would need to protect her daughter herself if the court did not defend her. The videos had convinced her that the girl, at times, tried to deter her father from continuing inappropriate contact. The child’s grandfather also questioned the absence of a clear legal safeguard, asking where the protective measures were. This was not the first instance of the minor using her phone to alert relatives about her father’s behavior, which had become increasingly troubling for the family.

With the court schedule disrupted by vacations, decisions on suspensions and protective orders remained in limbo. The mother reported that the complaint of sexual assault had reached the court with a prior request for injunctive relief before the abduction claim by the father, and that she remained on the island. She explained that she had personally driven the investigation and arrest concerns, describing how the court’s response appeared delayed. The mother hoped for timely intervention when the responsible official returned from leave, fearing for her daughter’s safety in the meantime. She insisted that she would not place her daughter with the father while the harassment case remained unresolved, resolved only by a formal closure of the investigation, not an arbitrary halt.

The broader atmosphere around the case remains tense. The mother has repeatedly stated that she is determined to shield her daughter, even as the process winds through a byzantine set of court actions, police reports, and medical records. The struggle reflects a larger conversation about safeguarding minors in family disputes where abuse allegations exist. The family awaits the return of the court official to determine the next steps and ensure the child’s safety.
