Evictions and foreclosures: second quarter 2023 overview

Evictions declined again in the second quarter of 2023, dropping 32.7 percent year over year to a total of 7,279 units. This data comes from the Statistical Service General Assembly of the Judiciary in its report analyzing the crisis impact on the judiciary and its operations.

Of the total launches, 5,306 cases (72.9 percent) stemmed from procedures under the Urban Tenancy Act, while 1,497 cases (20.6 percent) were due to mortgage foreclosures. The remaining 476 cases arose from other reasons.

According to the published report, foreclosures fell by 37 percent compared with the previous year, procedures under the Urban Rents Law declined by 32.6 percent, and launches for other reasons decreased by 16.2 percent.

Catalonia led in total launches

Catalonia registered the highest number of launches, with 2,274 cases representing 31.2 percent of the national total, making it the autonomous community with the most filings in the quarter. The Valencian Community followed with 1,090, Andalusia with 1,051, and Madrid with 561.

When considering only launches from Urban Tenancy Law procedures, Catalonia again topped the list with 1,621 cases, accounting for 30.6 percent of the total. The Valencian Community reported 803, followed by Andalusia with 658 and Madrid with 492.

For foreclosures, Catalonia had the highest figure with 415, followed by Andalusia with 316 and the Valencian Community with 251.

The report also includes figures for launches requested via joint reporting and seizure services, noting that the service is not available in every jurisdiction. The data quantify evolution but do not present absolute values. It also notes that a broadcast request from a partner service does not guarantee fulfillment.

With these facilities active, data show that the number of launches requested for shared services in the second quarter of 2023 stood at 13,516, which is 21.1 percent lower than in the same quarter of 2022. Of these, 6,248 resulted in positive compliance, marking a 32 percent decrease from the prior year.

Foreclosures down 17.3 percent year over year

The report records 5,161 mortgage foreclosures in the second quarter, a 17.3 percent drop from the same period in 2022.

The highest absolute number occurred in Andalusia with 1,064 cases, representing 20.6 percent of the national total. Catalonia followed with 1,027 cases, the Valencian Community with 821, and Madrid with 567.

When measured by population, the Valencian Community stood out with a foreclosure rate of 15.7 per 100,000 people, and Castilla-La Mancha registered 13.4.

Most base clause sentences are predictive

The report notes an increased entry of specialized courts in the second quarter of 2023, with 21,522 issues regarding ground provisions, up 2.5 percent vs. the same quarter in 2022.

A total of 29,669 cases were resolved, down 19.9 percent, and 145,201 cases were expected to be processed, down 21.7 percent. A total of 24,624 penalties were issued, with 97.4 percent resulting in positive outcomes.

800 cases of occupied housing

Regarding verbal judgments where property owners include individuals, non-profit organizations, or public bodies owning social housing, the report notes 797 such matters in the second quarter of 2023, up 2.3 percent from the previous year.

The largest number of cases (195) occurred in Catalonia, representing 24.5 percent of the national total. The Valencian Community followed with 137 cases; Andalusia with 130; and Castilla-La Mancha and Madrid each with 57.
