Criminal Court Case in Elche: Six-Month Sentence and Compensation for Assault on a National Police Officer

Criminal court no. 2 in Elche delivered a verdict in which the defendant received a six-month prison term along with a monetary compensation totaling nearly 19,000 euros. The proceedings concern an incident from December 19, 2019, in which a person accused of assaulting a national police officer during an attempt to identify and apprehend him violently resisted, kicking and punching two officers who intervened to stop the escape. The legal representation for the officer involved was provided by the JUPOL union, which publicly addressed the outcome of the case.

Medical assessments connected to the assault described significant injuries. One officer sustained damage including a complete rupture of the acromioclavicular ligaments, a grade II sprain of the coracoclavicular ligaments, and a dislocation of the right acromioclavicular joint, accompanied by arthralgia in the left ankle. Police reports noted residual pain in the right shoulder, ongoing limitations in shoulder movement, and a visible lump and scar on the right shoulder, all contributing to a period of reduced functionality and discomfort.

The court determined a civil liability payment of 18,905 euros, covering damages and related compensation, alongside 9,890 euros designated for injuries and 9,015 euros for consequences arising from the incident. In addition to the civil and injury-related awards, the defendant faced a six-month jail term for the assault, and was subjected to a daily fine for a specific duration, with additional prison days imposed for non-payment of installments. A separate provision addressed a minor injury offense, resulting in a separate daily fine and court costs being allocated accordingly, all reflecting the severity of the event and its impact on the person assaulted.

JUPOL expressed satisfaction with the conviction, indicating that the ruling should contribute to repairing the harm done to the National Police officer and, to some extent, support the restoration of the authorities’ jurisdiction in the line of duty. The outcome is presented as a clear statement about accountability for acts of aggression against law enforcement personnel, reinforcing the standards that guide professional conduct and public safety across the region.
