A deputy from the Communist Party submitted a draft law to the State Duma that may allow a temporary halt of draft decisions until a court ruling is finalized, if a citizen appeals them. This information comes from the Duma database.

The proposed amendments aim to update the law on military service. Explanatory materials note that an analysis of law enforcement practice showed that errors in assessing a person’s fitness for military service frequently lead to appeals against conscription in court.

The initiative’s author argues that misdiagnosis during examinations by military medical commissions can cause individuals who are physically or mentally unable to fulfill military duties to end up serving in the Armed Forces. Such cases, he contends, may even pose risks to fellow service members. A provisional suspension of the draft decision would help prevent endangering soldiers and avoid situations where a conscript under training becomes a burden to colleagues.

The draft also points out that the current Alternative Civil Service law already contains a provision that allows reconsideration if a citizen objects to a draft commission’s refusal to replace military service with civilian service. The author asserts that this inconsistency undermines the constitutional principle of equality because there are no political or legal grounds for such unequal treatment.

In the past, the State Duma introduced a measure to gradually raise the military age for service to 21 years. The new bill contemplates a further gradual increase, setting the upper age limit for military service at 30 years over time, balancing readiness with demographic and social considerations.
