The events occurred in a house in Istanbul in February of this year, though the location cited for the legal action is Murcia. The judicial decision describes the victim and the aggressor as a couple. During a confrontation, the aggressor shouted insulting phrases such as “You’re a whore, you’re a pig, you spent the night playing pig” while banging into walls and other objects. The barrage of words and actions forced the victim to seek shelter in a room where the children were present, and the scene left those nearby frightened and shaken.
Three months after the incident, Criminal Court No. 3 of Murcia found the man guilty of threats within the family environment. The sentence imposed one year of prison and prohibited him from approaching within 200 meters of the victim for two years.
He appealed the sentence
The defendant filed an appeal with the County Court, arguing that there was no sufficient evidence tying him to the crime he had been convicted of. The appellate court, however, noted that the victim’s account was corroborated by additional sources: a neighbor who witnessed part of the event, an aunt of the couple’s children, and the National Police agency that responded to the home at the time of the incident.
According to the court, the trial judge, who evaluated the evidence directly and weighed the credibility and consistency of the victim’s statements, reached a reasonable and rational conclusion. The appellate court emphasized that there was enough incriminating, legitimate, and properly admitted evidence to sustain the conviction, reaffirming that the presumption of innocence did not negate the results of the evidence. The court further noted that no ground existed to overturn the judgment, indicating that the appeal should be rejected.
