In a Benidorm courtroom, a man accused of sexually assaulting his six-year-old daughter at his home in 2020 rejected the allegations on Wednesday during the trial at the Alicante Court of Auditors, while his former partner confirmed the complaint filed at the time. The trial, which is set to conclude on Friday, heard the child’s pre-recorded statement as evidence, and prosecutors along with the private accuser, represented by attorney Alejandro Dapena for the mother, initially requested a ten-year prison sentence and 15,000 euros in moral damages.

According to the charges, on December 9, 2020, the defendant was at a Benidorm residence with his six-year-old daughter, acting with libidinous intent and after pulling down the girl’s pants, touching her intimate parts.

Masturbation

The accusations contend that the defendant went on to insert his fingers into the girl’s vagina, then lowered his own pants and masturbated in front of his daughter.

The defendant has vehemently denied the accusations, telling the court that on the day of the incident he was at his parents’ home with his mother and the girl, where they were playing, jumping, and dancing together.

The accused linked the complaint to prior conflicts with his ex-partner, who he says violated the custody arrangements and prevented him from seeing his daughter. He claimed that on the day in question she called him to pick up the child from school, took her to his parents’ house for lunch, and later enrolled her in gymnastics. He noted that his ex-partner had previously filed a complaint against him for violating a restraining order and had been cleared, while he had filed charges against her for aggression, for which she was convicted.

As the session continued, the prosecuting team emphasized the seriousness of the alleged acts and the impact on the child’s well-being. The defense questioned the timing of the alleged events and suggested inconsistencies in the account, urging the court to weigh the testimony carefully against the documentary evidence presented. The judge and the jury are evaluating the credibility of each witness, including the child’s statement, the testimonies of relatives, and the historical context of the family’s dispute. The outcome hinges on the interpretation of the events and whether the prosecution can establish guilt beyond a reasonable doubt, given the sensitive nature of the charges and the age of the victim.
