The Córdoba Instruction Court No. 2 issued a conditional-release decision this Thursday, with precautions, in a case involving a mother who was among those detained for abandoning her newborn in a park in Malaga on October 14. The court noted that the woman remains under investigation for allegedly abandoning her child, with the precise charges to be determined as the inquiry proceeds.
An injunction accompanied the release order, restricting the mother from approaching the baby, withdrawing her passport, prohibiting travel beyond national borders, and requiring her presence in court as the investigation continues.
The 26-year-old father was also brought before a Malaga court this Thursday. He faces potential charges related to abandoning the child, while authorities may consider other serious allegations depending on how the investigation unfolds. At this stage, officials have not ruled out the possibility of additional charges, and the case remains under close judicial scrutiny.
In connection with the detention, the presiding judge imposed safeguards on the father, including a ban on contact with the infant, passport withdrawal, travel restrictions, and regular court appearances to monitor the case under the jurisdiction of Malaga Instruction Number 10.
National Police officers arrested both parents on suspicion of involvement in an attempted murder related to the infant. The child, reported to be in good health, prompted the Andalusian government to initiate protective measures to ensure the minor’s welfare and safety.

A passerby discovered the naked newborn in a state of hypothermia around 08:30, and the infant was transported to hospital by a National Police patrol vehicle. The baby’s condition prompted immediate protective measures and ongoing medical assessment to ensure proper care.
Investigators gathered multiple pieces of evidence that illustrate how the child may have been abandoned in the vicinity of the park. Reports indicate that the child’s removal from the scene occurred after several hours, with the suspects allegedly leaving the vicinity and not informing anyone of the newborn’s presence.
