Now, in case of breach of obligations, shareholders will be able to apply to the law on the protection of consumer rights. In this case, the penalty to the developer will be 50% of the amount given to him for housing defects. The bill proposes to reduce the payments to 5%.
The bill also proposes to reduce the amount of penalties to be sent to shareholders. Compensation will be paid if the developer delays the deadline for fixing defects in the apartment or if the buyer refuses to reimburse the costs of fixing them.
So, if the housing was purchased for personal needs, the amount of the penalty will be 1/150 of the daily refinancing rate of the Central Bank of the Russian Federation of the cost of expenses to eliminate the problems. If it is not possible to live in the apartment due to deficiencies, this depends on the contract price. Also, when purchasing housing for commercial purposes, the calculation will be made at the rate of 1/300 of the Central Bank of the Russian Federation. Currently, this penalty is 1% for each day of delay.
The document will enter into force on September 1, 2024.
