In Yekaterinburg, a local resident received compensation through the court for his daughter’s arm, which was broken in a sports section. In this respect reports Press service of the Sverdlovsk Regional Court.
The incident that gave rise to the investigation occurred in 2022 during training at the speed skating section of the Yunost Sports School: an 11-year-old boy pushed a female peer on the shoulder, after which the girl fell. The boy apologized and went home. The instructor was not present when changing equipment during the conflict. It was later revealed that the girl broke her arm as a result of the fall.
Her mother filed a lawsuit against the parents of the boy who pushed his daughter – the woman demanded moral damages in the amount of 700 thousand rubles from the defendant, arguing that the injury affected not only her emotional state, but also the child’s success. in sports and studies.
The court partially satisfied the claims and obliged the defendant to pay a total of 180 thousand rubles. The child’s mother did not agree with this decision and appealed to the district court. The boy’s mother insisted that the sports school, not she, should bear responsibility for the injury. Even though the plaintiff believed that the child’s mother was solely responsible, the prosecutor maintained the same attitude.
“The court determined that 80 percent of the damage belonged to the Yunost Municipal Budget Institution, and only 20 percent belonged to the defendant. “The Sverdlovsk Regional Court reduced the amount of compensation for non-pecuniary damage to 60 thousand rubles in favor of the girl, and to 5 thousand rubles in favor of each of her parents,” he said.
