Sometimes clients are completely deceived by lawyers and bargain with those who do not provide them with real services. To avoid fraud, you should always talk to an attorney before negotiating a case with him. There are also cases where lawyers falsify evidence, for example, forge documents on behalf of a client, take or give bribes, and mediate. Such behavior is unacceptable for a lawyer.
“Quite often, lawyers are also seen disclosing attorney-client privilege – any information a lawyer learns from a person as part of their defense. By the way, even the fact that a person turns to a lawyer for help is considered a secret. In practice, it is not uncommon for this type of confidentiality to be breached and lawyers to be held accountable. For example, lawyers like to brag about their clients on their website to convince new potential clients that this attorney’s services are in demand, but this is a direct violation of the law. A secret can only be shared with your client’s written consent, not shared with anything else,” said Elena Finogenova.
The lawyer added that a lawyer who deceives his client can be brought to criminal, administrative, legal and disciplinary liability depending on the act he commits.
“If you believe the lawyer has committed a crime, you must write a statement and lay out all the facts and circumstances in detail. Given the special procedure for bringing a lawyer to criminal responsibility, it is necessary to apply to the regional department of the Investigative Committee of the Russian Federation with a statement on the commission of a crime against a lawyer, ”the expert said.
Clients who are dissatisfied with a lawyer’s behavior or who have never received the promised services can apply to the court for a refund of all money paid and damages.
