The plaintiff stated that her two-year-old daughter fell ill for two days after tasting the pastry, which turned out to be cherry.
“From time to time, the Plaintiff offers his daughter an apple pie-like delicacy. Despite plaintiff’s sadness and disappointment, she believed the pie in question was apple pie, fed it to her sick daughter, and was sick all weekend,” the claim statement reads.
