a federal court in California (USA) Man depicted as a baby on iconic ‘Nevermind’ album cover dismisses lawsuit (1991) by Nirvana and accused the rock band of child pornography, local media reported on Monday.
Spencer Elden, now 31, loses for the second time his lawsuit against former members of the group. for the cover where she looks naked under water while staring at a dollar.
Judge Fernando Olguín dismissed the complaint on Friday because Elden had known for more than a decade that he was the hero of this album, and took too long to make your claim.
Last January, the same magistrate dismissed Elden’s first case for not responding to Nirvana’s former members and heirs’ request for the case to be dropped within the specified time limit.
Olguín was then open to changing his decision if the plaintiff filed a new lawsuit, which was eventually dismissed.
In his original complaint, Elden blamed Nirvana: deliberately and commercially promoting child pornography and using the power of their image to promote themselves and its music.
The lawsuit also argued defendants benefited and continue to benefit from Elden’s “commercialization of sexual exploitation”.
Among those named in the lawsuit were Dave Grohl and Krist Novoselic, who formed the classic band Nirvana with Kurt Cobain (1967-1994).
The lawsuit also targeted “Nevermind” cover photographer Kirk Weddle and Courtney Love, the widow and heir to the Cobain estate.
He also blamed Chad Channing, who was a drummer in the early years of Nirvana and left the band in 1990, before ‘Nevermind’ was released.
On the cover of ‘Nevermind’, considered one of the most iconic pieces in rock history, a baby dives into a pool and hunts for banknotes.
As a teenager and an adult, Elden jumped back into the pool to recreate it over and over.
For example, he did so in 2016, when the album was a quarter of a century old, while on other occasions he showed his displeasure to the press for being linked to this image.
