If a Russian decides to cancel a housing transaction, the probability of success depends on what stage it is at. Inkom-Real Estate agency analyst Denis Vasiliev spoke about this, writes RIA Novosti.
If we are talking about buying and selling a house, and the transaction has not yet been concluded, then canceling it without consequences is quite simple. The parties do not sign the documents and do not disperse.
But in the case of purchasing an apartment in a new building, for which an equity participation agreement (DPA) has been signed and payment has been made, everything becomes much more complicated. Termination of the contract at the initiative of the shareholder is possible only if the quality of work does not meet the initially specified criteria, the transfer of housing is delayed for two months or more, or the developer fails to eliminate deficiencies that reduce the quality of life in the apartment.
Once the money is signed and transferred, the secondary home purchase and sale contract can only be terminated by mutual agreement or you will have to go to court.
