Foodway, a Russian company specializing in the distribution of various soft drinks, has applied to the Patent Disputes Chamber requesting that Dr. Pepper be deprotected from soda-related trademarks (TK). The company wants to produce this product directly in the domestic market, but has not yet received the appropriate permission for this, informs The newspaper Vedomosti, with reference to Rospatent data.
Representatives of the Chamber of Patent Disputes will consider this objection on February 28, 2023. And two weeks later, on March 14, the Intellectual Property Court will consider Foodway’s claim against the European Refreshments Unlimited Company (ERUC), part of international company Coca-Cola. The article states that ERUC owns the rights to the Dr.Pepper trademarks.
“If the products under the brands are not produced within 3 years, the legal protection of the brands ends. But this drink was no longer produced in Russia much earlier. Thus, ERUC is trying to keep the brand to itself, while it does not produce the drink in the country itself, ”says the material.
According to Foodway director Nikolai Komarevtsev, the company has all the necessary resources to produce Dr. Pepper drinks in Russia. However, the ERUC has not yet responded to his company’s objection to the possibility of transferring the rights to manufacture these products in the Russian Federation.
“Over 12 years, 5 legal entities Dr. Changed so that trademark protection as the copyright holder of the Pepper brand is not removed. Foodway is interested and has the opportunity to engage in the production of the drink, ”Comarevtsev concluded.
