The summer season begins and lines of cars drive out of town. However, in the territory of garden partnerships, not all have parking spaces. Therefore, cars are often parked in areas without buildings.
It turned out that it is quite possible to get a fine for this. And quite large – from 5,000 to 300,000 rubles for parking on the lawn, warned lawyer Elena Kuderko.
*This material was created by a person who has the status of a foreign agent in the Russian Federation.
She explained that in the early 2000s, the process of demarcating the land of dacha communities, settlements, and SNTs happened simultaneously with the privatization of plots. At the same time, common lands, as a rule, were not registered in the SNT.
This has led to the boundaries of common lands in such agglomerations having a very complicated shape, formed according to the residual principle. The municipalities accepted some land under the ramps on their balance sheets for development, but did not allocate them, ”explains the expert.
Therefore, a fine for allegedly parking on the lawn can be challenged. It is reasonable to do this if the lawn is not visually defined. For example, there is no road / pedestrian zone / additional planting (lawns, flowerbeds).
A legal complaint requires not only a description of the fact, but also photographic material, with which the judge can visually verify the validity of your arguments and the absence of a lawn, Kuderko concluded.
