An unusual legal outcome has emerged from a collision involving a rented scooter and a parked car in Tatarstan. The Supreme Court of the Russian Federation ruled that the rider, rather than the scooter owner, bore responsibility for the incident.
Following the crash, which occurred when the scooter rider collided with a vehicle in a parking area, the car owner sought compensation for the damages. The initial court sided with the traffic police, imposing a small fine on the scooter rider for driving with a faulty braking system (part 2, article 12.5 of the Code of Administrative Offenses of the Russian Federation).
However, the Supreme Court of Tatarstan overturned that decision, striking down the driver’s punishment on the grounds that the accident circumstances had not been proven. The scooter owner was nonetheless ordered to pay 180,000 rubles to the injured car owner.
When the case proceeded to the Supreme Court of the Russian Federation, responsibility shifted again toward the scooter rider. The court indicated that the scooter controlled the vehicle’s trajectory as it moved toward the parked car, creating the impression of driver fault from the sun’s position.
The proceedings have since moved to the appellate level, with the Supreme Court of Tatarstan now set to review the case on appeal.
