Apple, the iPhone owners in California’da filed a $ 5 billion collective claim. About it reports Macrumors broadcast.
The plaintiffs accuse the technological giant of violating the state law on other laws on the protection of consumer rights and consumer rights. The reason for the case was the claim that Apple deliberately misleaded users, and in Apple Books Annex, while creating the impression of digital electronic books for continuous use, consumers actually acquired recall licenses for these work.
The filed claim is that Apple has to delete digital books and audio books from the Apple Books application in case of loss of license for appropriate content. As a result, as mentioned in the complaint, some users have unexpectedly found that although the full cost was paid for themselves, there were no digital books that they could not be used before reinstalling. The plaintiffs say that Apple deleted books without prior notice and compensation.
The case emphasizes that the purchasing page in the Apple Books application is not connected with service conditions or license information. At the same time, to configure and use iPhone, iPad, Mac or other Apple devices, users must accept various license agreements for the company’s software. As stated in the case, these agreements include a clause that the use of software in connection with the Apple account or other Apple services means consent to valid service conditions, including the “conditions and provisions of Apple Media services”.
In the “conditions and provisions of the Apple Media services ği applied by the plaintiffs, it is stated that the obtained content is available for installation, reinstalling or other access from Apple. However, it is inaccessible for more installation or access after purchasing the content from the services, for example, in case of loss of Apple, from the content supplier. In this context, Apple recommends that users upload all content purchased to their devices and create spare copies to provide continuous access.
The case was filed on Tuesday at the US Regional Court in San Jose. The plaintiffs receive compensation for damage to 5 billion dollars, including the recommended sacrifice group of all people who buy digital books or audio books at the Apple Books store.
