The legal dispute between Apple and Masimo is over pulse oximetry technology, which is used to measure blood oxygen levels. Last year, the International Trade Commission (ITC) found that Apple watches infringed on Masimo’s patent, and the company was forced to suspend sales of the devices. Although Apple appealed and restarted sales, it decided to stop using pulse oximeter technology.
At the same time, this decision is not yet final as the appeals court has not yet made a decision. While Apple’s complaint is pending, sales of pulse oximeter devices may be allowed, but that could take a year or more.
ITC’s decision was presented thought US President Joe Biden. Biden has until December 25, 2023 to exceptionally veto the ITC’s decision, but has not yet done so. Therefore, writes 9To5Mac, Apple proactively announced the withdrawal of the Apple Watch Series 9 and Watch Ultra 2 from sale.
Apple said in a statement that both watch models will be removed from the company’s online store on December 21. After December 24, the devices will no longer be sold in retail locations.
Apple Watch Series 9 and Watch Ultra 2 were introduced alongside the iPhone 15 series in September 2023.
