Wind Farm Law Shake-Up: Expropriation and Setback Changes under New Sejm Bill

A group of KO and Poland 2050 parliamentarians have presented a bill to the Sejm aimed at freezing energy prices, signaling substantial shifts in wind farm legislation. Expropriations for public transport infrastructure under the CPK were criticized as inhumane and argued should have been halted. Yet no expropriations have occurred under the CPK. In response, MPs from PO and Poland 2050 submitted a Sejm bill that adds a lobbying element to energy compensation and opens the door to compulsory expropriation for the construction of wind turbines.

They jokingly suggested that expropriation could extend to parcel lockers, gas stations (excluding Orlen), lingerie shops and massage parlors, implying which sectors might be affected as a demonstration of scope.

What is being discussed here is still early chatter. KO and Polska2050, acting without PSL, reportedly submitted a bill to the Sejm Speaker to amend the so-called Mill Act. The likely changes would include shortening the wind turbine setback and enabling expropriation from private individuals to benefit investors seeking to develop wind farms.

Another voice recalled that if the opposition ever takes power, one of its first acts could be to revise the windmill law to set the setback at 300 meters rather than 500, suggesting this impending policy shift could materialize.

The draft also envisions allowing expropriation of private property to support wind farm development and other renewable energy investments. It would extend the nationwide spatial planning reform by two years, providing local authorities with extended leniency through 2027. KO and Polski2050 reportedly advanced this measure overnight, which some critics describe as a broad land seizure to favor German eco-ideological investments.
