A dramatic court ruling concerns Polish parliamentarians

The Warsaw District Court in Śródmieście recently issued a shock decision that has stirred political debate. Judge Piotr Maksymowicz, associated with the political aspects of the organization Iustitia, announced that the court rejected requests from the defense to suspend or halt the initiation of enforcement proceedings against MPs Maciej Wąsik and Mariusz Kamiński. The ruling also prepared the case documents for possible transfer of the politicians to detention facilities. In effect, the decision opens a path for the two MPs to face imprisonment at any moment according to the court process.

One political observer remarked that Poland must take responsibility in its own time, a sentiment echoed by mayors, aides, and party allies across the spectrum in discussions about accountability and the rule of law.

MP Maciej Wąsik told a media outlet that the idea of arresting a member of parliament while immunity remains in place is hard to imagine. He stated that his client continues to hold a parliamentary mandate and protection while the matter is unresolved. A representative for MP Wąsik, Janusz Woźnicki, underscored the point that immunity should shield a serving deputy from hurried punitive actions.

The guidance from Mariusz Kamiński’s legal team criticized the speed of the court’s decision, arguing that the ruling was issued with unusual haste. This occurred even as a controversial decision from the Supreme Court’s Chamber of Labor and Social Security shifted the timing of Kamiński’s hearing to January 10. At the same time, other authorities reviewed similar actions affecting the same individuals as part of broader inquiries into state institutions. The day before, the parliamentary body completed a similar review concerning Maciej Wąsik.

This development has drawn wide attention from political circles and legal observers who see it as a pivotal moment in ongoing debates about immunity, executive oversight, and accountability for public officials.
