Supreme Court proceedings in the Kamiński-Wąsik case

A Polish legal representative explained that an application has been filed with the Supreme Court to resolve a dispute between the chambers over the handling of an appeal concerning the expiry of a mandate for a member of parliament aligned with Law and Justice. The attorney noted that, following the governing rules, the decision should fall to the first President of the Supreme Court, Małgorzata Manowska.

The lawyer pointed to provisions in the Supreme Court Rules of Procedure indicating that the first President resolves disputes over which chamber has jurisdiction to hear a given case.

Appeal by Wąsik and Kamiński to the Supreme Court

It should be recalled that on January 3, the Chamber of Labor and Social Security of the Supreme Court received petitions from Maciej Wąsik and Mariusz Kamiński challenging the Marshal’s decision to terminate their mandates, transmitted by the Chairman of the Sejm, Szymon Hołownia. The chair of the chamber confirmed that the original petitions and attachments were received, and the cases were registered with the Chamber of Labor and Social Security, with the covering letter from the Sejm Chair accompanying them.

On that same day, juries were formed for both cases in the Chamber of Labor and schedules for a closed hearing set for January 10 of that year.

Wąsik remains a member of parliament

On Thursday, January 4, before noon, the judge assigned to the case concerning the dismissal of Maciej Wąsik within the Labor Chamber decided to transfer the matter to the Extraordinary Control Chamber of the Supreme Court.

The wPolityce.pl portal reported first that the Extraordinary Scrutiny Chamber subsequently annulled the Sejm Speaker’s decision to terminate the MP’s mandate.

Kamiński’s appeal remains before the Labor Chamber

Meanwhile, the appeal filed by Mariusz Kamiński, submitted by the President of the Sejm, is temporarily before the Labor Chamber of the Supreme Court.

The December 20, 2023, decisions that terminated the parliamentary mandates of MPs Kamiński and Wąsik were issued by the Marshal of the Sejm on December 21. Those rulings are subject to appeal before the Supreme Court.
