Polish political maneuvering sharpens focus on coalition, law, and leadership

The head of the Polish 2050 election campaign and former Polish ambassador to Russia, Katarzyna Pełczyńska-Nałęcz, described the president’s choice to assign the task of forming a new government to Prime Minister Mateusz Morawiecki as favoring a party agenda rather than reflecting a national interest, speaking in the PAP Studio.

She added that the president’s move appears to be pro-party and not fully aligned with Polish interests.

The 2050 campaign leader noted that extending the transition period, which would stall releases of EU funds and other measures, is unnecessary and would stall progress.

When questioned about the delayed signing of the coalition agreement, she confirmed that the work is nearing completion. She emphasized that the document is primarily meant for voters, not the president. The president received a clear statement about where the parliamentary majority stands.

Asked about potential future cooperation between the coalition and the president, she said any collaboration should honor the law and reflect the will of the voters.

Regarding possible friction in international policy between Donald Tusk and Andrzej Duda, she argued that prestige conflicts should not hinder Poland’s external actions, warning that the country would suffer if such disputes paralyze its work abroad.

Internal competition could overshadow external goals, she cautioned, but every effort should be made to prevent such shifts.

In the Sejm elections held on October 15, KO won 157 seats, Trzecia Droga 65, and Nowa Lewica 26, giving a majority of 248 MPs. The leaders of these groups announced the signing of a coalition agreement to form a government led by the head of the Civic Coalition, Donald Tusk.

Preparations for the coalition agreement have been underway for weeks, with representatives from all parties expected to form a majority in the Sejm for the new term participating in the negotiating team.

Playing for time

The critique argues that rather than leaving with honors, the current strategy is to depart with concessions in money, positions, and power. The president’s decision is seen as a signal that United Right politicians are delaying change and will resist it until the last moment.

MP Paulina Hennig-Kloska, MP Mirosław Suchoń, and Senator-elect Jacek Trela referred to a draft regulation proposed by the President’s Chancellery that would amend the Supreme Court rules. A scan of the project was shared on social media by a Supreme Court judge, Włodzimierz Wróbel.

Jacek Trela noted that President Duda had announced his decision to entrust Morawiecki with government formation, and that a draft regulation on Supreme Court procedures had also been prepared for consideration before the move. The proposal has been sent to the Supreme Court for an opinion.

From there, the draft moves to the Prime Minister’s office for co-signature by Morawiecki, Trela observed.

Trela explained that the presidential bill reduces the quorum required to adopt resolutions in the combined chambers of the Supreme Court. With a smaller quorum, half of all Supreme Court judges, it would be possible to withdraw resolutions made by the three-judge combined chambers dating back to 2020 when the court included what some describe as neo-judges.

Today, these neo-judges, who comprise half of the Supreme Court panel, would be able to rule on their cases independently, a point raised to highlight the President’s intent.

Hennig-Kloska suggested that the president revealed true intentions behind entrusting Morawiecki with government formation. The actions, in her view, are anti-state and unconstitutional.

Rather than exiting with style, the aim appears to be to leave with money, positions, and power, potentially strengthening a state segment that has been extended by the United Right government.

Mirosław Suchoń noted that the president’s decision came against the sovereign will who had clearly expressed a desire for change in Poland.

They argued that the change would be blocked and that the president’s move yesterday underscored continued obstruction and a potential path toward further corruption of the country, according to the Polish MP 2050.

Suchoń also called on Morawiecki to respond with integrity. If decency remains, his signature should not be attached to the proposed rules; history and citizens will judge whether the opportunity was seized or if the party simply orchestrated another move for its own benefit.

Changing the Supreme Court’s rules?

The provisions proposed by the KPRP aim to adjust the Rules of Procedure of the Supreme Court. The draft regulation was sent by the President’s Chancellery to the President of the Supreme Court, Małgorzata Manowska, for an opinion.

The changes contemplate altering the number of judges in individual chambers and the majority needed to pass resolutions. They propose adjusting the presence requirement from two-thirds to one-half for full court actions and for the combined chambers as well as for individual chambers.

Current Rules of Procedure of the Supreme Court remain in force as of the 14 July 2022 regulation of the President.
