Plan to suspend neoKRS and pursue accountability in the judiciary

“NeoKRS can disappear in a single day, just as the so-called students of the Constitutional Court did,” remarked Prof. Krystian Markiewicz, a judge and president of Iustitia, in a statement featured on the Onet portal.

In the same report, the professor notes that the Minister of Justice must be someone fully aware of the events from the last eight years. The suggestion mirrors a belief that the rule of law has faced a total crisis, one that was not anticipated by either political or social circles. The judge describes the situation as a collapse of the legal order that did not have a prior blueprint for recovery.

Markiewicz emphasizes that there is a need to acknowledge the wrongs that affected many people. He then outlines what he calls a contingency plan: a Gordian knot that cannot be untied through deliberation alone, but that can be resolved with decisive action. He argues that a Sejm resolution could declare the election of the National Council of the Judiciary invalid and suspend the activities of the illegal body known as neoKRS. According to him, such a resolution would be irrevocable, leaving no role for the President in this matter. He frames the move as a dismantling of political influence over the judiciary and declares that those lights will be turned off.

Revenge plan

The judge stresses that citizens should not feel endangered by the transformation, asserting that recent judicial decisions made by the so-called neo-judges will not be annulled. He adds that anyone who took advantage of the breakdown in the legal system, created under the PiS government, will face consequences.

Disciplinary actions will be pursued, and criminal charges may follow. He frames this not as vengeance but as a rightful response to deep-seated wrongs that harmed people within the justice system.

– notes Markiewicz

The plan includes naming individuals who should bear disciplinary responsibility, with a call to address the failures that allowed abuse of power within the judiciary. The judge points to figures connected to the disciplinary apparatus who were appointed during the current administration and insists they must be held to account for alleged crimes.

The association of judges, Iustitia, responds positively to the parliamentary results, viewing them as an opportunity for accountability and a reshaping of authority within specific bodies and courts.
