“The Minister is obliged to implement the court decision and must do so as quickly as possible, without undue delay. That time has long since passed, the minister did not do it and may have to bear criminal or constitutional liability for violating the duties with which he is charged as a public servant,” said constitutionalist prof. on TV Trwam. Anna Łabno, pointing to the Minister of Finance. “All the actions we observe against the law and against state institutions are typical of authoritarian systems,” she warned.
Domański has a duty!
As the days pass, the Minister of Finance, Andrzej Domański – who is practicing a kind of legal juggling by sending letters to the National Electoral Commission – is still not paying out the money due to Law and Justice.
Prof. Anna Łabno emphasized on TV Trwam that the time for the payment of the money had already passed, because the decision had to be implemented immediately.
All formal conditions have been met. The court stated this following a complaint filed by PiS, and the court’s decision is final. It puts an end to all debate on this subject and regardless of what anyone thinks, that is what the court is for, to objectively decide the rights of each party in this dispute.
– said the constitutionalist.
The Minister is obliged to implement the court decision and must do so as quickly as possible, without undue delay. That time has long since passed, the minister did not do it and may have to be held criminally or constitutionally liable for breaching the duties he is charged with as a public servant.
she added firmly.
““Typical for authoritarian systems”
In the program “Polish point of view” Prof. Anna Łabno explained that in this case it was not the first time that the government chose to instrumentalize the law.
This is purely political and intended to achieve its own goals. This means instrumentalizing the law, that is, using the law not in the general or general interest, not for the public interest, and not to solve existing problems. And we’ve been observing this for over a year now on a scale beyond imagination. Even those of us who remember the difficult times of the Polish People’s Republic are aware that these are incomparable times, because today (…) we still have freedom of expression within the limits as it is now, but all activities that we observe are against the law, against state institutions, they are typical of authoritarian systems that destroy the law, destroy society, deprive it of freedom
– she assessed.
Society itself must now strive to regain this freedom and decide what is law, what is legal and what is not.
– she pointed.
