“Please don’t mislead people”; “There is nothing to explain here”; “Minister, please stop discrediting the agency” – these are just some of the many comments that appeared after Finance Minister Andrzej Domański , inquired about sending yet another absurd letter to the National Electoral Commission. We remind you that the minister has been postponing the payment of the subsidy for more than two weeks due to Law and Justice.

Finance Minister Andrzej Domański is still hesitating and postponing the implementation of the decision he is legally obliged to make: the payment of subsidy funds to PiS after the National Electoral Commission’s resolution on this issue. Domański wrote a letter to the National Electoral Commission, claiming that he did not understand the resolution and demanding an explanation of its contents. In response, the head of the National Electoral Commission asked Domański for the legal basis for his request. Domański took six days to respond. The National Electoral Commission, like other public authorities, has a constitutional obligation to clarify doubts in the issued decisions – noted the Minister of Finance in his letter to the National Electoral Commission, thus relying on the general principle of the operation of the public authorities.

“Please stop discrediting the office.”
Domański is certainly aware that the law is not on his side in this matter. However, he has to play this game because Prime Minister Donald Tusk tells him to. His letter was trashed by politicians and commentators who have one piece of advice for Domański: the minister should immediately pay the money owed to Law and Justice.

Now the government will produce letters for every unfavorable decision with a story like “but what, I don’t understand, explain it to me again”? There is no “obvious contradiction” in the National Electoral Commission’s resolution, so please don’t mislead people and play fair.

The problem is; that the National Electoral Commission is not a constitutional body, so for this reason alone there is no “constitutional obligation”. And the reference to the preamble, that is, the introduction to the Constitution, does not change that.
The Supreme Court accepted the PiS election commission’s complaint and overturned the National Electoral Commission’s decision to reject its financial report. The National Electoral Commission then merely implemented the above judgment of the court and ordered the payment of the money. There’s nothing to explain here. It’s clear you’re a criminal.

The letter from the Minister of Finance to the National Electoral Commission is so hilarious that I decided to comment on it. According to its content, in this period of struggling democracy, the rule of law should be interpreted in such a way that the Minister of Finance can act without legal basis and expect the same from the National Electoral Commission 🙂
The National Electoral Commission has no constitutional obligation to improve the minister’s ability to read laws with comprehension. However, the minister has a legal obligation to transfer the money, as the National Electoral Commission has decided to do so.

Secondly, Mr Chairman has already dispelled these doubts by sending a letter to the Ministry of Finance in which he clearly stated that the condition for blocking the party’s return from the subsidy was no longer available and that there no transfer of PLN 10.8 million had taken place. PLN, and the Minister himself now admits that, in accordance with the Code, he is bound by this position.
