The Deputy Attorney General, whom Adam Bodnar is trying to fight, has filed a lawsuit in the District Court of the capital Warsaw, Warsaw. “They demand, among other things, that Adam Bodnar’s letter has no legal consequences. In the coming days, as a result of Adam Bodnar’s actions since January this year, further legal action will be taken against his deputies,” said lawyer Bartosz Lewandowski.
At the end of last year, the Minister of Justice, Attorney General Adam Bodnar, tried to dismiss his legal deputies: Robert Hernand, Michał Ostrowski and Krzysztof Sieraka from the headquarters of the neo-national prosecutor’s office.
We declare that Attorney General Adam Bodnar attempted to illegally deprive us of the positions of Deputy Attorney General. In the following days of December, he sent us letters announcing that we had been referred to selected departments of the National Public Prosecutor’s Office, based on Art. 31 par. 1 point 1 of the Public Prosecution Service Act and par. 56 section 1 point 1 of the Regulations on the internal management of the common organizational units of the public prosecutor’s office

Since January 2024, the Attorney General has taken action against the plaintiffs, with the aim of preventing them from exercising the de facto function of deputies of the Attorney General. This was related to criticism of Senator Adam Bodnar’s illegal actions, which consisted in preventing National Prosecutor Dariusz Barski from exercising his duties, and to actions against other prosecutors taken by Prosecutor Jacek Bilewicz and Dariusz Korneluk.

The lawyer pointed out that the illegality of these actions was confirmed by the Supreme Court and the Constitutional Court in their resolution.
Adam Bodnar’s actions against the plaintiffs include: initiating disciplinary proceedings against them, sending them on mandatory leave with a ban on entering the building, removing all cases under the supervision of deputies and supervisory departments, and ordering of work limited to, for example, preparing an analysis and discussing tens of thousands of cases relating to prohibited acts against the environment and animals, as well as VAT crimes. In December 2024, the Prosecutor General presented his deputies with letters ordering them to perform their duty outside the headquarters of the Public Prosecution Service (for example, Prosecutor Michał Ostrowski has to perform this duty in Wrocław, which results in him traveling almost 260 km to work must travel per day without the possibility to request an expense reimbursement).

In light of the provisions of the 2016 Act – Public Prosecution Act, the Attorney General cannot make such decisions on the transfer of deputies, as this effectively means that they cannot co-manage the Public Prosecution Service and dismiss them . exercise this function without the written consent of the President of the Republic of Poland (Article 14).

In the lawsuit, the deputy attorney general demands, among other things: Declare that Adam Bodnar’s letter has no legal effect. In the coming days, as a result of Adam Bodnar’s actions since January this year, further legal action will be taken against his deputies.
