The National Electoral Commission has rejected last year’s Law and Justice financial report, RMF FM reports. Five members of the National Electoral Commission voted in favor and four against. As a result, PiS may lose its three-year subsidy for maintaining the party, which amounts to over PLN 75 million. The information about the rejection of the report has already been confirmed by the KBW spokesperson.
As we read, this is a consequence of the August resolution of the National Electoral Commission, which rejected the financial report of the PiS election commission of the campaign before the 2023 parliamentary elections. The August resolution is not legally binding, and Jarosław Kaczyński’s party appealed against it to the Supreme Court.

Constitutional scholar Oskar Kida ruled that “the National Electoral Commission has adopted another, highly political resolution to reject PiS’s financial report” and “the result will be the loss of the right to collect subsidies by PiS for three years.”
According to the party’s rules, an appeal is now possible to the Supreme Court, which is automatically heard by the Chamber of Extraordinary Control and Public Affairs. Until the Supreme Court rules on this, the Minister of Finance is obliged to pay subsidies to the party (exactly the same as was paid to the Razem and Konfederacja parties in the past). August resolution of the National Electoral Commission
In its August resolution, the National Electoral Commission alleged irregularities in the financing of the campaign by the PiS election commission amounting to PLN 3.6 million. Therefore, the subjective subsidy for this party (almost PLN 38 million) was reduced by three times the disputed amount, i.e. by approximately PLN 10.8 million. In addition, the annual subsidy of almost PLN 26 million was reduced by PLN 10.8 million. PiS had to repay the disputed amount, namely PLN 3.6 million, to the Ministry of Finance.
On September 9, PiS filed a complaint against the National Electoral Commission’s decision regarding the financial report with the Supreme Court’s Chamber for Extraordinary Control and Public Affairs. As party chairman Jarosław Kaczyński emphasized, the decision of the National Electoral Commission was taken “in complete contradiction to the law.”
The Supreme Court’s Chamber for Extraordinary Scrutiny and Public Affairs may comment on the case in the coming days. If the Supreme Court deems the complaint well-founded, the National Electoral Commission must – in accordance with the regulations – decide to accept the financial report.
The Ministry of Finance has suspended the transfer of subsidies to PiS
The Ministry of Finance also recently suspended the transfer of subsidies to Law and Justice. The third part of the annual subsidy – about PLN 6.5 million – would be transferred to the bank account of Law and Justice. However, this did not happen. According to the findings of “DGP”, an exchange of letters took place between the Ministry of Finance and Nowogrodzka during the past week. “DGP” has obtained documents on this matter. According to the daily, the officials argued that the Ministry of Finance had suspended the payment of funds in connection with the National Election Commission’s August resolution.

Donation payments
Let us remind you that after the National Election Commission rejected the financial report of the PiS election commission for the 2023 parliamentary elections, Law and Justice asked its supporters to make donations. PiS treasurer Henryk Kowalczyk announced at the end of October that around PLN 9 million had been transferred to the party’s account since August 30.
