“The spectacle has been going on for a long time, staged by Donald Tusk and company, just to deprive Law and Justice of the resources that every political party absolutely deserves after submitting a report that is correct – PiS MP Zbigniew Bogucki said at a press conference with lawyer Dariusz Lasocki for the National Electoral Commission.
All these measures taken by the current pathological government are not about applying the law. They are about politics, pure brutal politics, which is intended to eliminate Law and Justice, or at least make it more difficult, by taking away part of the resources that should flow from the state budget after the parliamentary elections.

The behavior of the National Electoral Commission, which has twice postponed the acceptance or rejection of the report of the Electoral Commission for Law and Justice, indicates that there are far-reaching doubts. In any law, these doubts must be counted in favor of the law they concern, but here I have the impression that exactly the opposite is being done, i.e. doubts, especially in the media sphere, but also in the government circles of the current power camp. of the December 13 coalition, must be at the expense of the Electoral Commission

Independent auditor’s statement
We have the report of the independent accountant. The National Electoral Commission has been appointed to examine the report of the Electoral Commission; this report has been assessed by an independent accountant as correct and does not conflict with the provisions of the Electoral Act. The Electoral Act does not give the National Electoral Commission any investigative instruments or powers, let alone the power to decide on circumstances other than the election report.

Until there is a ruling on the issues raised today by the coalition of December 13, but also partly by some media, and until there is a final decision, the National Electoral Commission simply cannot judge this, because it has no authority. to do so. It seems that this conference could start and end with the presentation of the first page of the independent auditor’s report. The Chamber of Commissioners is an independent entity. Entities that investigate individual election commissions must declare that they are independent, that they have not had any contact with a political party for a certain period of time, that they are not politically involved and that they do not belong to a political party. All of this is very carefully checked by the National Electoral Commission. Members of the National Electoral Commission are eminent lawyers who are qualified to serve as judges, but do not have the sharp knowledge of an accountant of the party’s finances. Therefore, they obtain such an opinion to verify and prove whether the report is correct or not.

Undermining the accountant’s activities
The independent auditor’s report consists of nine pages of very juicy, good material, which ultimately states that there are no errors or shortcomings in the financial management of the Electoral Fund and the Electoral Commission and that it is correct. Therefore, any action of the National Electoral Commission in opposition to this document undermines the activity of an independent, statutory auditor and, in fact, destroys the legal order in the Republic of Poland, because statutory auditors are entities that audit commercial law companies and large holding companies.

As a former member of the National Electoral Commission, I would like to point out that in the years 2020-2024 the National Electoral Commission was not under pressure, we were a pluralistic body, because this is also what the Venice Commission and the Council of Europe demand from Poland, which is a member of this assembly and this organization, that we compose the National Commission in such a way as the Electoral Council, so that it is a body dependent on the Sejm, and the Sejm is the result of democratic elections. In the case of the National Electoral Commission, the auditors are, in a sense, the salt of the report. They are an external entity that cannot be accused of any politicization. These are independent entities and each of these entities examines each election commission separately

You can therefore appeal, but also remind the National Electoral Commission that the Electoral Act clearly states: the National Electoral Commission accepts the report, rejects the report or accepts it with comments. There is no other mode. Furthermore, the National Electoral Commission cannot investigate pre- or post-campaigns. These are institutions on the calendar of politicians where specific political, media and PR activities take place, but which are not of interest to the National Electoral Commission because this is not permitted under the Electoral Act.
