““In order to run for a Polish commissioner, the formal and written consent of the president is required,” Mieszko Pawlak from KPRP told Polsat News. Marcin Kierwiński, a Civic Platform MEP, responded arrogantly to these words by stating that in his opinion the law adopted last year was not valid. “The prime minister will probably inform the president out of courtesy,” he said.
On Friday, Donald Tusk said that he will give his opinion on “who should be the Polish commissioner in the European Union” during the next government meeting. He added that he “expects agreement” from the head of the European Commission, Ursula von der Leyen, regarding his proposal. When Tusk asked about these statements, Minister of the CPVO Mieszko Pawlak replied that In accordance with applicable law, before being officially nominated, a candidate must obtain written approval from President Andrzej Duda.
Formal written authorisation from the President is required for submitting this application to the European Commission
– said in Polsat News min. Mieszko Pawlak.

This will be a “blatant violation of the law”
When asked whether there would be a meeting between the President and the Prime Minister regarding the candidacy of our Commissioner to the European Commission, Mr Pawlak replied stating that this was not necessary.
This is not a meeting between the President and the Prime Minister, but rather compliance with applicable regulations, that is, submitting a request to the President in this regard
– the presidential minister said, adding that any other action would be a violation of the law.
I find it difficult to imagine such a blatant violation of the law by the Prime Minister of the Republic of Poland.
– Mieszko Pawlak added.
Hearing these words, Civic Platform MEP Marcin Kierwiński arrogantly attacked the presidential minister.
What PiS did before was one big violation of the law. The Prime Minister will probably inform the President as a courtesy. This will be sent to Brussels
– said the former head of the Ministry of Internal Affairs and Administration, stating that in his opinion the provisions on the selection of a candidate for commissioner do not apply.
According to the constitution, foreign policy is conducted by the government, and the law passed last year is unconstitutional. It is not valid because it is against the constitution. PiS could pass different laws, but this does not change the established order
– the Civic Platform politician pontificated, adding that there is no Constitutional Tribunal today.
Kierwiński was answered by PiS MP Piotr Müller
Today you are a one-man tribunal and in the next television program you are the final court. You want to have a monopoly on power, keep everything in one hand. There is a law and it is your duty to follow it
– former government spokesman Mateusz Morawiecki responded sharply. Sławomir Mentzen of Konfederacja also joined the discussion.
The law is believed to be constitutional all officials are required to follow it, including the Prime Minister, whether he likes it or not
– Mentzen said. Kierwiński’s zeal was tried to be curbed by his coalition partner, Senator Maciej Żywno from Poland 2050. According to him, however, the president should not oppose Tusk’s decision.
This indication from the Prime Minister must be accepted by the President, otherwise it could cost us the loss of the Commissioner
– says the Vice President of the Senate.
